North Ford Solicitors is pleased to share the successful outcome of a recent case in which we acted for the Defendant in a neighbour dispute involving property matters. Our Client was represented by Salmaan Islam and Fabbiha Chowdhury of North Ford Solicitors, and Counsel was Thomas Dawson from Tanfield Chambers. The case was heard at the County Court.
The dispute arose between the Claimant and our Client concerning neighbouring properties. The Claimant alleged that works carried out by our Client’s contractors caused trespass and property damage, claiming damages capped at £20,000. Our Client denied the allegations, asserting that liability for the contractors’ actions was misplaced and that the Claimant’s claims were exaggerated. Our Client also lodged a counterclaim, citing nuisance caused by vegetation on the shared fence and aggressive behaviour by the Claimant, seeking damages and an injunction to prevent harassment.
The Claimant’s case was struck out due to non-compliance with an "unless" order application that we submitted on behalf of our Client to the Court requiring document disclosure. The Claimant’s subsequent application for relief from sanctions was dismissed, with the court emphasising that being unrepresented does not excuse procedural failings. The court upheld the overriding objective of the Civil Procedure Rules, citing consistent procedural non-compliance and lack of evidence as reasons for denying relief. Our Client was successfully awarded costs, with partial deductions for withdrawn counterclaims.
This case highlights the importance of procedural compliance in litigation and the challenges of resolving neighbour disputes. The court’s decision underscores the need for parties to adhere to court orders and provide timely evidence.
